FAQ – What is Mediation and Arbitration?
editMediation and arbitration are alternative dispute resolution processes to help resolve a dispute in a fair and equitable manner.
*
Mediation involves the intervention of a third-party impartial and neutral professional who helps to facilitate open discussions between the parties to help them reach their own agreement.
*
Arbitration, on the other hand, involves an arbitrator – also a neutral third-party – who acts more like a judge. An arbitrator listens to both sides and has the power to make a final, binding decision on the matter based on the evidence and law.
*
Both methods are less formal and more flexible way to resolve a dispute than going to court.
*
Collective Agreements outline the process used for dispute resolution. Always ensure to review the Collective Agreement to learn more about what options and processes are in place.
